One of the most common questions clients ask a notary is: “Do I need an acknowledgment or a jurat?”

Choosing the wrong notarization can cause your document to be rejected, delayed, or even considered invalid. This guide explains the difference in simple terms so you can walk into your notarization appointment confident and prepared.

What Is an Acknowledgment?

An acknowledgment focuses on identity and willingness, not truthfulness.An acknowledgment confirms that:

  • The signer personally appeared before the notary

  • The signer confirmed they willingly signed the document

  • The document may have been signed before the notarization

The notary does not administer an oath or affirmation.

What Is a Jurat?

A jurat focuses on truthfulness under oath. A jurat is used when the signer must:

  • Personally appear before the notary

  • Sign the document in front of the notary

  • Take an oath or affirmation swearing the contents are true

The notary must witness the signing and administer the oath.

Who Chooses the Notarial Certificate?

This is important: ⚠️ The notary cannot choose for you.

The document author, receiving agency, or attorney determines whether an acknowledgment or jurat is required. A California notary is prohibited from providing legal advice or selecting the certificate on your behalf.
